Is Weed Legal in Bangkok? Tourist Rules for 2026

Last checked:

Last verified: 22 October 2026. General information, not legal advice.

If your mental image of Bangkok still includes a cannabis shop on every corner and a "weed is legal!" headline from 2022, it's time for an update. Thailand has spent the last three years walking that decision back, and the rules for tourists in 2026 are much tighter than the shopfronts suggest.

The short version

  • Recreational weed is not legal in Bangkok. Since 26 June 2025, cannabis flower has been a controlled herb, sold only with a prescription issued in Thailand for medical use, capped at a 30-day supply (PRD).
  • Tourists can't just walk in and buy. The Tourism Authority of Thailand says visitors may not use, buy, carry or transport cannabis flowers without a valid Thai-issued prescription (TAT).
  • Smoking in public can cost you up to a month in jail, a fine of up to 2,000 baht, or both.
  • Flying out with weed can cost a lot more: 30,000 baht per kilogram plus confiscation, with a legal maximum of 10 years in prison.
  • The rules are still moving. A new "medical use only" bill was approved by the Cabinet in September 2026 but is not yet law.

Is weed legal in Bangkok in 2026?

Only as medicine. Thailand removed cannabis from its narcotics list in June 2022, the first country in Asia to do so. The result was thousands of shops and very few rules.

In June 2025 the Ministry of Public Health reclassified the flower as a "controlled herb". Selling it now requires a licence, and buyers need a prescription. Online sales, vending machines and advertising are banned (PRD).

The TAT is blunt about it: recreational use "has never been legally permitted" (TAT).

As of 22 October 2026, Prime Minister Anutin said cannabis's legal status is unchanged. Flowers remain controlled, and licensed shops can sell medical products only, not rolled joints (Thairath).

The Cabinet approved a bill in September 2026 that would put "medical use only" into statute. It still has to pass parliament (Bangkok Post).

Can tourists buy weed in Bangkok?

Not legally, without a Thai prescription. Your medical card from home does not count. The only lawful route for a visitor is:

  1. a genuine consultation with an authorised practitioner in Thailand;
  2. a prescription limited to your medical need, for no more than 30 days;
  3. filling it at a licensed seller.

The Thai medical cannabis authority says patients can receive up to 30 g of flower a month. They should carry their medical certificate or a copy of the prescription, and use it in private without causing a nuisance (DTAM FAQ, in Thai).

Why you still see shops. Existing dispensaries can operate until their licences expire, and the government expects standalone shops to be gone by 2029. New licences in 2026 go mainly to clinics, pharmacies and herbal-product stores. The TAT warns that shops selling for smoking, especially to walk-in customers, "may be operating outside the law".

Our advice: stay away from street dealers, and from anyone selling through LINE, Telegram or Instagram. Online sales are banned outright, so every one of those sellers is breaking the law, and plenty of them are scams too.

Bangkok weed penalties

Situation Possible penalty
Smoking in public (nuisance) Up to 1 month and/or 2,000 baht
Selling without following the rules (no prescription, online, etc.) Up to 1 year and/or 20,000 baht
Carrying cannabis out of Thailand 30,000 baht per kg plus confiscation (since 17 Jun 2026); legal maximum 10 years and/or 500,000 baht
Vapes (any kind) Illegal to possess or use; fines and detention possible

A rule that only takes a minute to break can still have consequences for months. The UK government says you can be held in detention if you can't pay a Customs fine, and you'll be placed on an immigration watchlist. Thailand's new deportation rules, in force since August 2026, can apply even without a criminal conviction (FCDO).

Thailand airport rules: Suvarnabhumi & Don Mueang

  • Leaving: exporting cannabis without permission is illegal, even with a Thai prescription. Bags are X-rayed, and Customs is actively looking. It recorded nearly 3,000 cannabis-export cases between October 2025 and May 2026 alone (Thai Customs).
  • Never carry a bag or parcel for someone else. Courier recruitment is a known trap.
  • Arriving: don't pack CBD oil, gummies or hemp cosmetics. Thailand's FDA doesn't allow passengers to import cannabis- or hemp-based foods, cosmetics or herbal products. Leave the vape at home too.
  • Flying on? Singapore can impose the death penalty for trafficking more than 500 g of cannabis. Malaysia and Indonesia also keep the death penalty for drug trafficking. The FCDO warns that even transiting with cannabis risks arrest.

Is CBD legal in Thailand?

Yes, within the FDA system. CBD is allowed in medical and cosmetic products regulated by the Thai FDA, from Thai-grown plants and with no more than 0.2% THC. Products from abroad are a different story: an extract from foreign-grown hemp can be treated as a narcotic.

If police stop you

  • Stay calm and carry a copy of your passport.
  • Don't offer a bribe; that's a crime in itself.
  • Ask for the Tourist Police (1155).
  • If you're detained, ask for an interpreter and for your embassy to be notified. Don't sign anything you can't read.

Other emergency numbers: police 191, ambulance 1669.
