Is weed legal in Las Vegas? Yes, for adults 21 and over, within Nevada's limits. But "legal to have" is not "legal to use anywhere". Using cannabis in public, in a vehicle or in a cannabis store is a misdemeanor, casinos keep well away from it, the airport bans it and the federal land around the city follows federal law (NRS 678D, CCB).
The short version
- 21 and over only, with a valid government photo ID (CCB FAQ).
- Possession limit: 2.5 oz of cannabis or 1/4 oz of concentrated cannabis, or a mix within the limit (NRS 678D).
- No use in public or in a car. That includes the Strip and anywhere open to public view, with a fine of up to US$600 (NRS 678D).
- Casinos and hotels are off-limits in practice: gaming regulators keep cannabis out of casinos, and a hotel can ban it on its own property (Gaming Policy Committee, NRS 678D).
- Driving high is DUI, even though cannabis is legal (NRS 484C).
Law vs. practice
Nevada's adult-use law (NRS chapter 678D) protects adults 21 and over from state prosecution when they possess, use or transport cannabis within the limits. The limits are 2.5 oz of usable cannabis and 1/4 oz of concentrated cannabis (NRS 678D).
That protection has edges. It doesn't cover driving under the influence, use in a public place or in public view, or giving cannabis to anyone under 21 (NRS 678D). A hotel or other property owner can ban cannabis on their property, and the ban on public use covers anywhere open to the public or in public view, including parks and sidewalks (NRS 678D).
What this means for a visitor: the law protects what you carry, not where you use it. In Las Vegas most of the places a visitor spends time are places where you can't use it.
Penalties
| Situation | What the law says |
|---|---|
| Adult 21+, within 2.5 oz / 1/4 oz concentrate | Exempt from state prosecution |
| Using it in public, in a store or in a vehicle | Misdemeanor, fine up to US$600 |
| Under 21 using a fake ID to get cannabis | Misdemeanor |
| Giving cannabis to someone under 21 | Misdemeanor (gross misdemeanor if under 18) |
| First DUI within 7 years | 2 days to 6 months in jail or 48 to 96 hours of community service, a fine of US$400–1,000 and a course |

Border & airport rules
- The airport bans it. Clark County Code makes it unlawful to possess or use cannabis anywhere on Harry Reid International Airport property, including terminals, parking and roads (Clark County).
- TSA says its officers don't search for illegal drugs, but they refer anything illegal they find to law enforcement (TSA). TSA's page now shows "Yes (Special Instructions)" for medical marijuana; this does not override the airport ban above (TSA, Clark County).
- Federal land is federal law. Cannabis stays illegal on federal land, including national park areas such as Lake Mead (CCB, 36 CFR 2.35).
- Leaving Nevada? Federal law still bans possession, and the next state's rules apply as soon as you cross the line (21 U.S.C. 844).
Legal options
Nevada's system is built on licensed, tested products for adults 21 and over, and use is allowed in a private residence where the owner allows it (CCB). Nevada also licenses consumption lounges as a legal category, with their own rules: no one under 21, no consumption in public view and no alcohol (CCB FAQ). We don't name any stores or lounges.
Culture & etiquette
Keep it out of sight. A balcony facing the Strip or a pool deck is still public view, and many parts of the Strip are full of families. Read your hotel's house rules before you check in, and never mix cannabis with a casino visit (NRS 678D, Gaming Policy Committee).
Scams to watch for
- Street and social-media sellers. Unlicensed sales are illegal, and the product is untested (CCB FAQ).
- "Legal" products from smoke shops. Shops without a cannabis licence can't sell cannabis; hemp shops must post a "NOT LICENSED TO SELL CANNABIS" sign (CCB FAQ).
- Mystery delta-8. The CCB warns that converted delta-8 products can contain harmful by-products (CCB).
Harm reduction & if things go wrong
- Edibles: the CCB advises starting with no more than 5 mg of THC and waiting at least 2 hours before taking more (CCB).
- Don't mix cannabis with alcohol, and drink water in the desert heat.
- Too much? Call Poison Control on 1-800-222-1222; for severe symptoms call 911 (CCB).
- Emergencies: 911.
- If you're arrested and you're not a US citizen, you can ask for your consulate to be told (Vienna Convention on Consular Relations, Art. 36).
